1. About this Privacy Policy

At Nautycal Pty Ltd (referred to as “Nautycal”, or “we”, “us”, "our") we work hard to maintain your trust and confidence by handling your personal information with respect and putting you in control.

This policy is intended to meet requirements globally and applies to any of our websites, including, but not limited to, Find a Crew™ or CrewScene™ (“Websites”). If you do not agree with this Privacy Policy, you may not use any of the our websites or services.

Many of our products require some personal data to provide you with a service. If you choose not to provide data required to provide you with a product or feature, you cannot use that product or feature.

NOTE  Our notice to you via email constitutes acceptable notice to you under this policy. We are not responsible or liable for (and have no obligation to verify) your failure to receive notice if the email is quarantined by your email security system (e.g. “junk” or “spam” folder), if you fail to update your email address, or if you have provided a wrong or misspelled email address.

2. What personal information is collected?

We collect personal information about you mainly when you give it to us, and through your interactions with our Websites.

The personal information we collect depends on your use of our websites and the choices you make: you control the personal information you share with us and with other members, and you have the choice to limit your sharing or visibility settings.

Your personal details such as your surname, email address and phone number will not be visible to, or shared with, other members or visitors, unless you decide to change your visibility settings in your account.

  • Information you give to us. For example, your contact information, including first name, last name, date of birth, email address, telephone number, your current location and IP address. You also might provide us with your passport, ID document of any sort for identity verification, or any qualification. This also may include boat details such as registration and hull type;

  • Information about your location. For example, if you are browsing our websites with your mobile device, you can decide to enable us to see your current location (e.g. to see the nearest boat, city, port, marina, facilities or services);

  • Credential information. For example passwords, hints and similar security information used for authentication and access to accounts and services;

  • Information we collect when you use our services. This includes network and connection information such as your operating system and the type of browser you use, language, time zone and technical information such as the type of device you use. We might automatically collect those types of information when you visit our websites and whether or not you end up creating an account on any of our websites;

  • Information we collect when you sign in to your account. We create a record of your sign-ins, which includes the date and time, the website you signed in to, your sign-in name, the unique number assigned to your account, a unique identifier assigned to your device and your IP address.

We DO NOT store any financial data such as your Credit Card details or Paypal accounts. We DO NOT require any recurrent payment for any of our services, or on any of our websites. All the transactions processed on our websites are securely encrypted and instantly validated with the bank.

3. How is my personal information collected?

  • Directly from you, when you create an account you voluntarily share certain information including your name, email address, phone number, photos and any other information you give us;

  • When you visit one of our websites to read or browse;

  • Through your use of our services, such as your browsing history including the IP address, and your location information;

  • We use cookies and similar technologies to provide us with information about your usage of our websites, to support our functionality and to give you the best possible experience and service. Read our Cookies to learn more.

NOTE  Some of our websites use the services of Google Maps/Earth. The use of Google Maps/Earth is subject to the Google Maps/Earth Additional Terms of Use and Google’s Privacy Policy.

4. How is my personal information used?

We use the information collected about you for various purposes including:

  • To contact you. For example to send you technical notices, updates, security alerts and support and administrative messages;

  • To verify the information you provide us, including, if needed, to confirm your identity;

  • To maintain product quality and protect users;

  • To generate statistics in relation to our websites;

  • To provide, improve and protect our services;

  • To help us keep your account safe preventing fraud, spam and crime, and investigate any complaints or enquiries that you or any other member may raise.

5. How long is my personal information kept?

We keep your information while you are our member and as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements, or where the law requires us to keep it.

This is a case-by-case determination. In order to comply with the requirements of the European General Data Protection Regulation (GDPR), when we no longer need to keep your information to comply with our legal or regulatory obligations, we will either remove it from our systems or depersonalise it so that we cannot identify you.

We implement appropriate technical and organizational safeguards to protect against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Personal Data. However, we cannot fully eliminate security risks associated with service interruption, system failure, storage and transmission, and the permanent loss of data.

NOTE  We may preserve and share your information if we have a good-faith belief that it is reasonably necessary to:

  • Respond to applicable law or regulations, to legal process, or to government requests. For example, we might need to sort out disagreements, stop fraud and abuse or prove that you had an account with us;

  • Enforce our Terms and any other applicable terms and policies;

  • Protect the rights, property, and safety of our users.

In limited cases, the law permits us to keep your personal information indefinitely, provided that appropriate technical protection measures are put in place (such as anonymisation, encryption, etc). We will continue to use and disclose such Personal data in accordance with this Privacy Policy.

6. Is my personal information shared?

No, we don't share or sell your personal information to advertisers, other third parties or social media platforms of any sort. We do not allow tracking by third-party websites you have not visited; therefore none of the personal information, messages and/or contact details shared on any of the Nautycal Pty Ltd's websites will be indexed by search engines, including analytics services.

We may share your information across Nautycal Pty Ltd's group companies in full compliance with applicable data protection rules.

We only share information if we believe that disclosure is reasonably necessary to comply with a law, regulation or legal request; to protect the safety, rights, or property of the public, any person, or ourselves; or to detect, prevent, or otherwise address fraud, security or technical issues.

Transfer of your personal information to other countries:

We are a global online platform. Therefore, to enable us to give you the best service possible we will sometimes need to transfer and store your personal information internationally. Where we transfer your information to companies outside the EEA, we will ensure that any transfer of your information is compliant with data protection law.

The personal information we process, and all associated services and systems, including registration, is housed on servers located in strategic hubs around the world. Please note that the data protection and privacy laws in those countries may offer a different level of protection than in your country/region.

By using our services and websites and submitting your personal information, you agree to the transfer, storage, and/or processing of your personal information in Australia or in other countries strategic for us.

7. What about my personal information?

Are you GDPR-Compliant?

We are dedicated to making sure Nautycal Pty Ltd has taken all the necessary steps to meet full GDPR compliance. We want you to be in control of how your personal information is used or collected by us. You can do this in the following ways:

  • If you have an account with us, you can access, correct, update or rectified a significant amount of your personal information through our websites. If any personal information we have about you is not accessible through our websites, you can send us your request at verify@findacrew.net and we will process your request as soon as we’re reasonably able to, when possible;

  • When requesting a copy of your personal information, we reserve the right to charge an admin fee or refuse a request, where requests for personal information are clearly unreasonable or excessive, particularly if they are repetitive;

  • You have total control over what you decide to share or make visible to others throughout our websites;

  • You can close your account at any time. When you close your account, we’ll deactivate it. In certain situations, you can ask us to erase or restrict the processing of the personal information we hold about you. However, there may be circumstances where we are legally entitled to retain your personal information. Once your account is closed, you will not be able to retrieve, reactivate or re-connect your information. If you wish to use the services again, you will have to create a new account and accept and agree to our Policies and Terms again;

  • You control what communications you receive and can unsubscribe from newsletter emails and promotional material at any time however, we will still send you non-promotional communications, such as updates related to your account or system changes. Please delete your account if you do not wish to receive these emails;

  • We will notify you of any data breach involving your personal information if it is reasonable in the circumstances to believe that the breach creates a real risk of significant harm to you;

  • If you think that we haven't complied with data protection laws, you have a right to lodge a complaint contacting our Data Protection Officer using the form on the 'Contact Us' page or emailing us at privacy@findacrew.net.

NOTE  To exercise any of your rights, you will need to contact us providing the following information so that we can verify your identity: a colour copy of any of the account holder's valid government-issued photo ID such as Passport, driving licence or identity card, and the unique account number associated with that account.

8. How is my personal information protected?

We use a variety of physical and technical measures, policies, and procedures (such as access control procedures, encryption, network firewalls, and physical security) designed to protect our systems and your personal information.

We are unable to decrypt the encrypted content and, therefore, we cannot access it and we cannot use that encrypted content to identify any individual.

Please be aware that no method of storing or transmitting information over the Internet is completely secure. Therefore, we cannot guarantee the absolute security of any information. We do not accept liability for unintentional disclosure. Please also keep in mind that we cannot control the actions of users on our websites, who may use apps or devices to record, store, or share content without other users' prior consent.

We limit access to your personal data to those employees or contractors who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

You agree to notify us promptly of any unauthorised use of your username, password, other account information, or any other breach of security that you become aware of involving or relating to any of our websites.

How do you keep my personal information safe?

Our security measures comply also with the requirements of the GDPR and include:

  • Adopting a risk-based approach to securing the personal information of our users;
  • Using selective pseudonymisation and encryption of personal information kept by us;
  • Designing systems with the goal of enabling us to protect the confidentiality, integrity, availability and resilience of our processing systems and services;
  • Using systems and processes designed to give us the ability to restore the availability and access to your personal information in a timely manner in the event of a physical or technical incident;
  • Regularly testing, assessing and evaluating the effectiveness of our security measures.
NOTE  You’re responsible for keeping your personal and account information, such as your password, secure and not sharing it with others.
 

Data anonymisation and usage of aggregated information

Once you cancel your profile or if we no longer need your personal information, then your information may be de-identified and converted into statistical or aggregated data in such a way as to ensure that you are not identified or identifiable from it. We might use personal information to conduct research and analysis, including to produce statistical research and reports.

 

Storage and Security of Personal Information

Any information which we hold for you is stored on secure servers, either in Australia or in strategic hubs around the world, that are protected in controlled facilities.

Nautycal Pty Ltd will not be held responsible for events arising from unauthorised access to your Personal Information.

If you are located in a country within the European Economic Area (EEA), please be aware that the personal information and information that you provide to us may be stored outside the EEA. We will always ensure that your information is stored in accordance with this Policy.

How we handle emails

We will preserve the content of any e-mail or correspondence that you send us if we believe that we have a legal requirement to do so.

We reserve the right, but we ha no obligation, to read messages which originate from our websites in order to check compliance with our Terms of Service.

9. Children's Privacy

Our services are not directed at children under 13 years old. In limited cases, or in exceptional circumstances, we may collect and use the information of children only as provided by the parent or guardian, or with their consent.

If we become aware that we process information of a child under 13 years old without the valid consent of a parent or guardian, we reserve the right to delete it.

11. Does this policy change?

This policy may change over time. All changes will be published on this website. We encourage you to review this Privacy Policy to stay informed about our information practices and the choices available to you. Your continued use of our Services constitutes your acceptance of any amendment of this Privacy Policy.

The updated Terms or policies will be effective immediately upon posting and apply to any continued or new use of the Services. If you do not agree to the modified terms or policies, you should discontinue your use of our Services.
